PUBLIC NOTICE

 

1. Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Procedural Rules, notice is hereby given of the Application of Black Hills Power, Inc. d/b/a Black Hills Energy (BHP or the Company) for authority to decrease its Carbon Capture Compliance Surcharge to 0.00%.

2. BHP, a wholly owned subsidiary of Black Hills Corporation, is a public utility, as defined by Wyoming Statute § 37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to the provisions of Wyoming Statute § 37-2-112.

3. On September 3, 2024, BHP filed an Application requesting authority to decrease its Carbon Capture Compliance Surcharge to 0.00%. On December14, 2023, The Commission authorized Cheyenne Light, Fuel and Power Company (CLFP) and BHP to implement a Low Carbon Surcharge rate of 0.50% and apply the surcharge to the total electric bill effective March 1, 2024.

4. On March 15, 2024 new legislation amended certain provisions of the Low Carbon Energy Standards Statute exempting companies with less than 10,000 electric customers. As of December 31, 2022, BHP had 2,640 total Wyoming customers, exempting it from Wyoming Statute § 37-18-102 and Commission Rule, Chapter 3, Section 38, as of March 15, 2024.

5. Because there are no forecast costs for 2025 and the deferred balance is expected to be near zero, BHP proposes to set the 2025 CCC Surcharge Rate to 0.00% as of January 1, 2025. In the event that the Commission does not issue a final decision prior to January 1, 2025, the Company requests interim approval on or before that date.

7. Anyone wishing to file a statement, intervention petition, protest or request for a public hearing in this matter must do so in writing filed with the Commission on or before October 31, 2024. Any intervention request filed with the Commission shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding. Please be sure to mention Docket Nos. 20002-138-ET-24 in all correspondence with the Commission.
