ORDINANCE NO. 1, 2025 

AN ORDINANCE ANNEXING TERRITORY DESCRIBED IN THE PETITION FOR ANNEXATION, DATED JANUARY 10, 2025. 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWCASTLE, WESTON COUNTY, WYOMING:

 

SECTION 1: ANNEXATION OF TERRITORY

 

The City Council of the City of Newcastle does hereby annex the following described real property and improvements pursuant to the Petition for Annexation originally dated January 10th, 2025, and filed with the City Clerk:

A parcel of land located in the SW¼NW¼ Section 30, T.45N., R.61W., 6th P.M., City of Newcastle, Weston County, Wyoming, said parcel being more particularly described as follows:

 Commence at the West ¼ corner of said Section 30 being a found chiseled X marker from which the East ¼ corner of said Section 30 being a found aluminum cap monument bears N88°32’39”E, 5349.63 feet and is the Basis of Bearings for this parcel description;

thence N87°54’46”E, 414.65 feet to a found rebar monument at the southeast corner of that parcel of land described in Document No. 774219, recorded in Book 419, Page 97 in the office of the Weston County Clerk and Records in Newcastle, Wyoming and the POINT OF BEGINNING of this parcel description; 

thence from said Point of Beginning N1°06’44”W along the east line of said Document No. 774219, 277.76 feet to a found aluminum cap monument at the northeast corner of said document No. 774219 being coincident with the southeast corner of that parcel of land described in Document No. 761604, recorded in Book 367, Page 956 in said Clerk and Records office; thence continue N1°06’44”W along the east line of said Document No. 761604, 431.81 feet to intersect the southerly right-of-way line of the BNSF railroad and a set rebar with aluminum cap inscribed IME LS 5134, hereinafter referred to as a typical monument;

thence easterly along said southerly right-of-way line on the arc of a non-tangent curve to the left 420.02 feet to the northwest corner of that parcel of land described in Document No. 692742, recorded in Book 295, Page 242 in said Clerk and Records office and a typical monument, said curve having a radius of 2726.73 feet, a central angle of 8°49’33” and chord bearing S86°41’55”E, 419.61 feet;

thence S1°29’54”E along the west line of said Document No. 692742, 646.52 feet to the southwest corner of said Document No. 692742 being on the northerly right-of-way line of US Highway 16 and a typical monument; 

thence westerly along said northerly right-of-way line on the arc of a nontangent curve to the left 302.15 feet to a typical monument, said curve having a radius of 5804.35 feet, a central angle of 2°58’57” and chord bearing S80°42’12”W, 302.11 feet; thence N85°27’33”W along said northerly right-of-way line, 124.29 feet to the point of beginning of this parcel description containing 6.588 acres, more or less, and is subject to all easements, rights-of-way and restrictions of record.

SECTION 2: COMPLIANCE WITH WYOMING STATUTE §15-1-403 

The Petition for Annexation filed with the City Clerk is signed and dated by all landowners owning the area sought to be annexed and contains a legal description of the area sought to be annexed, a request the described property be annexed, a statement each signer is an owner of land and description of his land within the area proposed to be annexed and contained a map of the area all in compliance with Wyoming Statute §15-1-403.

SECTION 3: COMPLIANCE WITH WYOMING STATUTE §15-1-403(c)(d)

The Newcastle City Clerk within ten (10) days from the date the Petition for Annexation was filed determined the Petition substantially complied with the requirements of Wyoming Statute §15-1-403 and certified compliance of the Petition pursuant to the provisions of Wyoming Statute §15-1-403(d).

SECTION 4: PUBLIC HEARING

The governing body of the City of Newcastle established a date, time and place for a public hearing to determine if the proposed annexation complies with the provisions of Wyoming Statute §15-1-402 and at the public hearing determined the following:

1. Annexation of the area proposed would enhance the protection of the health, safety and welfare of the persons residing in the area and in the city or town;

2. The urban development of the area sought to be annexed would constitute a natural geographical, economical and social part of the City of Newcastle;

3. The area sought to be annexed is a logical and feasible addition to the City of Newcastle and the extension of basic and other services customarily available to residents of the City of Newcastle can reasonably be furnished to the area proposed to be annexed.

4. The area sought to be annexed is contiguous with or adjacent to the City of Newcastle; and

5. The City of Newcastle is prepared and does hereby designate Charter Communications, Black Hills Energy, and Range Communications Wyoming utility cooperatives and corporations serving Weston County, Wyoming, to serve the annexed area pursuant to Wyoming Statute §15-1-410.

SECTION 5: EFFECTIVE DATE

This ordinance shall be in full force and effect from and after its passage, approval and publication.
