Martinez sentenced
A Newcastle man will serve 12 to 15 years in prison after being sentenced in Weston County District Court for sexual abuse of a minor.
Nicolas Martinez was sentenced Feb. 17 by District Court Judge Stuart S. Healy III on one count of second-degree sexual abuse of a minor and one count of third-degree sexual abuse of a minor, both felonies.
According to court records, Martinez previously pleaded guilty to the charges on Nov. 25, 2025.
Healy sentenced Martinez to not less than 12 years nor more than 15 years in prison on each count, with the sentences to run concurrently. Martinez was also given credit for 213 days of presentence confinement.
“The court finds the defendant is not a good candidate for probation and that a term of incarceration is appropriate given the facts and circumstances of the offender and this case,” the order states.
Court records indicate Martinez was also determined to be an “addicted offender” under Wyoming law, but the court found incarceration was required in the interest of justice.
In addition to the prison sentence, Martinez was ordered to register as a sex offender in the county where he resides within five days of release.
The court also assessed fees and costs, including a $40 judicial systems automation fee, a $10 indigent civil legal services fee, a $75 substance abuse assessment fee and a $250 crime victims compensation fee. A $750 public defender fee was waived due to inability to pay.
According to the felony information, the charges stem from incidents that occurred on or about July 19, 2025, in Weston County involving a victim between the ages of 13 and 15, with Martinez being at least four years older.
The affidavit of probable cause filed in the case alleges that law enforcement responded to a report of sexual assault in Newcastle and later arrested Martinez following an investigation.
Martinez will be held in the custody of the Wyoming Department of Corrections to serve his sentence.Â
