Black Hills Wyoming Gas PUBLIC NOTICE
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Application of Black Hills Wyoming Gas, LLC, d/b/a Black Hills Energy (BHWG or the Company) requesting an order from the Commission confirming that the Choice Gas Program (the Program) continues to serve the public interest, results in just and reasonable rates, and is otherwise in harmony with Wyoming law, as more fully described below.
1. BHWG is a public utility subject to the Commission’s jurisdiction. Wyo. Stat. §§ 37-1-101(a)(vi)(D) and 37-2-112.
2. The Choice Gas Program was authorized in 1996 in Docket No. 30004-GT-95-37 as an innovative rate pursuant to Wyoming Statute § 37-2-121 under a new amendment allowing the use of innovative rates and service concepts shown to be consistent with the public interest. The Program, as originally approved, was designed to bring the benefits of price competition and competitive market choice in the purchase of natural gas to all classes of customers in BHWG’s eastern Wyoming service territory. The Program is currently available to BHWG customers in the Casper, Gillette, and Torrington divisions. Since the Program’s inception, the Company has filed multiple revision and expansion applications, resulting in public hearings and workshops to resolve contested issues and complaints.
3. On August 21, 2026, BHWG filed its Application at the direction of the Commission to show that the Program continues to serve the public interest, has just and reasonable rates, and operates in accordance with Wyoming law in compliance with the Order issued in Docket No. 90000-192-XO-26. The Application includes proposed Program revisions but excludes any proposal to expand the geographic territory to which the Program applies.
4. The Company proposes several tariff changes, stating the changes are to enhance and balance competition among Choice Gas Suppliers (Suppliers), increase customer transparency, eliminate certain Supplier marketing tactics, and improve Program clarity. Specifically, the Company proposes to reclassify the Gas Cost Adjustment (GCA) as a regulated rate option rather than a non-regulated Choice Gas Supplier, limit Supplier default pricing, eliminate non-commodity incentive offerings, require non-regulated Suppliers to publish pricing options, eliminate the Fixed Monthly Bill pricing option, and other minor clerical corrections.

6. Anyone wishing to file a statement, intervention petition, protest or request for a public hearing in this matter must file with the Commission in writing on or before October 2, 2026. Any intervention request filed with the Commission shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding.
