ORDINANCE NO. 3, SERIES 2021
 
AN ORDINANCE AMENDING CHAPTER 17, OFFENSES — MISCELLANEOUS TO INCLUDE SECTION 17-13.3 AND PROVIDING FOR AN EFFECTIVE DATE
 
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF NEWCASTLE, NEWCASTLE, WYOMING,
 
SECTION 1: NEW “SECTION”
A new “Section” 17-13.3 is hereby as follows:
Sec. 17-13.3. Adjacent landowners to maintain adjacent publicly owned right-of-way. 
Every Owner, Occupant, Person, or Contractor (Responsible Party) shall maintain all premises under their control or responsibility, including any adjacent publicly owned right-of-way, in a clean, sanitary and orderly condition at all times. Failure to do so shall be a misdemeanor. In addition, should the Responsible Party fail to abate a nuisance following an order as provided in Section 17-13 it shall be the duty of the chief of police acting through city employees to abate such nuisance and report the expense of the same to the city council, whereupon a suit may be instituted against the Responsible Party to recover the expenses incurred by the city abating the nuisance. 
SECTION 2: REPEALING CLAUSE
Any other ordinance or parts of ordinances in conflict with this ordinance are hereby repealed. 
SECTION 3: EFFECTIVE DATE
This Ordinance shall be effective upon passage and publication as provided by law.
