ORDINANCE NO. 5, SERIES 2019
 
AN ORDINANCE AMENDING SECTION 13-9(a) AND (b) OF ARTICLE II, CHAPTER 13 OF THE CODE OF THE TOWN OF THE CITY OF NEWCASTLE, WYOMING, 1961 TO INCREASE GARBAGE COLLECTION CHARGES BY TWENTY PERCENT (20%); AND PROVIDING FOR AN EFFECTIVE DATE
 
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF NEWCASTLE, WESTON COUNTY, WYOMING, that:
Section 1: Section 13-9(a) and (b) of Article II, Chapter 13 of the Code of the Town of the City of Newcastle, Wyoming 1961 shall be, and hereby is, amended to read in complete form as follows:
“Sec. 13-9. Charges for garbage collection by the City.
 
(a) Basic rates for the collection, removal, transporting and disposal of garbage by the employees and agents of the City shall be as follows:
 
(1) Within the City limits:
(A) 95 gallon capacity cans: The monthly garbage service collection charge for 95 gallon capacity cans collected within the City shall be $16.75 per month for each 95 gallon capacity can for one collection per week per can.    
 (B) 300 gallon capacity cans: The monthly garbage service collection charge for 300 gallon capacity cans collected within the City shall be as set forth in the following schedule:

For each additional 300 gallon capacity can in excess of eight 300 gallon capacity cans the monthly collection charges shall be as follows: $44.09 for one collection per week; $88.16 for two collections per week; $132.25 for three collections per week; $176.33 for four collections per week; and $220.42 for five collections per week.    
 
(2) Outside the City limits:
(A) 95 gallon capacity cans: The monthly garbage service collection charge for 95 gallon capacity cans outside the City shall be $25.12 per month for each 95 gallon capacity can for one collection per week per can.
(B) 300 gallon capacity cans: The monthly garbage service collection charge for 300 gallon capacity cans collected outside the City shall be as set forth in the following schedule:

For each additional 300 gallon capacity can in excess of eight 300 gallon capacity cans the monthly collection charges shall be as follows: $66.12 for one collection per week; $132.25 for two collections per week; $198.37 for three collections per week; $264.50 for four collections per week; and $330.62 for five collections per week.
 
(b) Additional collection charges: A customer may request additional collections of garbage by the City.  The charges for each additional collection of a customer’s cans shall be as follows:
 
Within the City limits:
(A) 95 gallon capacity cans: $33.08 per 95 gallon capacity can for each additional collection.
(B) 300 gallon capacity cans: $99.20 per 300 gallon capacity can for each additional collection. 
 
Outside the City limits:
(A) 95 gallon capacity cans: $49.60 per 95 gallon capacity can for each additional collection.
(B) 300 gallon capacity cans: $132.25 per 300 gallon capacity can for each additional collection.”
 
Section 2: This Ordinance shall become effective September 1, 2019 for that billing month, and upon publication as provided by law.

Passed on second reading: July 1, 2019.
