ORDINANCE NO. 1, SERIES 2020
AN ORDINANCE AMENDING SECTION 8-34 OF ARTICLE III, CHAPTER 8 OF THE CODE OF THE TOWN OF THE CITY OF NEWCASTLE, WYOMING, 1961 TO INCREASE THE COURT AUTOMATION FEE CHARGED AS A COURT COST FROM TWENTY-FIVE DOLLARS ($25.00) TO FORTY DOLLARS ($40.00) PURSUANT TO WYOMING STATUTE SECTION 5-6-108 AND RULE 2 OF THE WYOMING RULES FOR FEES AND COSTS FOR MUNICIPAL COURTS; AND PROVIDING FOR AN EFFECTIVE DATE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF NEWCASTLE, WESTON COUNTY, WYOMING, that:
SECTION 1: Section 8-34 of Article III, Chapter 8 of the Code of the Town of the City of Newcastle, Wyoming, 1961 shall be, and hereby is, amended to read in complete form as follows: “Sec. 8-34. Taxation and collection of costs. It shall be the duty of the police justice to tax the costs of every criminal prosecution or trial before him in every case which results in a conviction. Such costs shall be in the amount of fifty dollars ($50.00) in all criminal proceedings, and shall be assessed and collected by the police justice. Of the fifty dollars ($50.00) in costs, ten dollars ($10.00) shall be deposited in the treasury of the city and forty dollars ($40.00) shall be deposited in the State of Wyoming judicial systems automation account created by Wyoming Statute Section 5-2-120. In the case of conviction, such costs shall be part of the judgment.”
SECTION 2: This Ordinance shall become effective on July 1, 2020 following passage and publication as provided by law.
