PUBLIC NOTICE
Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Service Commission’s (Commission) Rules and Regulations, notice is hereby given of the Joint Application of Cheyenne Light, Fuel and Power Company d/b/a Black Hills Energy (Cheyenne Light), and Black Hills Power, Inc., d/b/a Black Hills Energy (Black Hills Power), for authority to amend the standard rate for purchasing power from qualifying small power production or cogeneration facilities tariffs and approval of the avoid cost calculation methodology effective June 1, 2020, as more fully described below:
Cheyenne Light and Black Hills Power are a public utilities, as defined in Wyo. Stat. §37-1-101(a)(vi)(C), subject to the Commission’s jurisdiction pursuant to Wyo. Stat. §37-2-112.
On March 30, 2020, the Companies submitted a Joint Application together with exhibits requesting the Commission grant authority to amend its tariffs for purchasing power from qualifying small power production or cogeneration facilities, as well as approval of its avoid cost calculation methodology.
Specifically, the Joint Application seeks approval of amendments to the existing 100 kW Tariffs. The amendments seek to with the Commission’s Order in the Renewable Ready Docket regarding potential risks to customers due to behind-the-meter generation. The Companies are proposing a buy-all, sell all tariff mechanism to address concerns with fixed cost recovery for customers.
The proposed amendments to the 100 kW Tariffs expand eligible generators to include qualified small power production or cogeneration facilities 26 kW and above.
The proposed amendments include a change to the names of the 100 kW Tariffs in order to expand the eligible customers- Standard Rate for Purchasing Power from Qualifying Small Power Production or Cogeneration Facilities 26 kW and Above (“26 kW Tariff”).
In addition, Cheyenne Light and Black Hills Power request approval of the avoided cost calculation methodology utilized to calculate the Energy Purchase Rate in the 26 kW Tariff.
This is not a complete description of the Joint Application. Interested persons may inspect the entire Joint Application at Cheyenne Light or Black Hills Power’s Wyoming offices and at the Commission’s offices in Cheyenne, Wyoming, during regular business hours. The Joint Application may also be reviewed on the Commission’s website at: http://psc.state.wy.us/.
Anyone desiring to file a public comment, statement, protest, intervention petition or request for a public hearing in this matter must file with the Commission in writing on or before May 8, 2020. Any intervention request filed with the Commission shall set forth the grounds of the proposed intervention or request for hearing as well as the position and the interest of the petitioner in this proceeding.
