MINUTES
TUESDAY, FEBRUARY 18, 2020
Mayor Debra Piana called this regular meeting of the Newcastle City Council to order at 7:00 p.m. Those present were Mayor Piana; Council members Roger Hespe, Michael Alexander, Ann McColley, Pam Gualtieri, Don Steveson and Tom Voss. Also present were Department Heads City Engineer Mike Moore, City Police Chief Jim Owens, City Attorney Jim Peck and City Clerk/Treasurer Greg James.
APPROVAL OF AGENDA: Roger Hespe moved, seconded Ann McColley to approve the agenda as amended, adding Public Hearing at 7:15 p.m. for the Boyd Avenue water project. Motion carried.
APPROVAL OF MINUTES: Don Steveson moved, seconded Tom Voss to approve the minutes of the regular meeting of Monday, February 3, 2020 as presented. Motion carried.

CITIZEN’S BUSINESS—IN WRITING:
Approval of Plumbing License, adding Apprentice and Journeyman Plumbers. Tom Voss moved, seconded Roger Hespe to approve adding an Apprentice Plumber, Daniel Whitney and a Journeyman Plumber, Louis Campbell for Midwestern Mechanical Rapid, Inc., all fees have been paid and proof of license, insurance and bond have been provided. Motion carried.
CITIZEN’S BUSINESS—VERBAL:
Tasha Townsend and Martha Bickford were present to ask for the City’s approval to continue the Fall Festival and Madness on Main for this year. Madness on Main to be Saturday, September 5 and the Fall Festival to be Saturday, September 19, 2020. Council approval granted by consensus.
PUBLIC HEARING: as advertised at 7:15 p.m. to consider comments regarding the Water Improvements 2019 Boyd Avenue. The record reflects there were no comments from the public reference this proposed project.
PUBLIC HEARING: as advertised at 7:30 p.m. to consider a transfer of name on Retail Liquor License #5 and to consider the renewal applications for the liquor licenses in Newcastle for the 2020—2021 license year. The Transfer of Name was read first, retail license #5, B&D Holdings, LLC change to B&D Holdings, Newcastle, LLC at 701 Washington Blvd. Tom Voss moved, seconded Roger Hespe to approve this change of name. Motion carried. The Licenses for renewal are as follows, Retail Liquor Licenses: Liquor License #1, Perkins Tavern, LLC dba Perkins Tavern; License #2, Short Stop #1, LLC dba Short Stop Fuel Mart; License #3, Deckers Food Centers, Inc., dba Smoke Shop Liquors; License #4, Cap & Bottle, LLC dba Cap & Bottle; License #5, D&B Holdings, Inc., dba TBA; License #6, Mini Mart, Inc., dba Loaf ‘N Jug #167; License #7, BW Convenience Retail dba Yes Way; License #8, Maverik, dba Maverik #458. Ann McColley moved, seconded Tom Voss to approve the liquor license renewals as presented. Motion carried.

DEPARTMENT HEAD REPORTS:
City Clerk/Treasurer Greg James brought for consideration and approval a Memorandum of Understanding between the City and the Senior Housing reference water usage. Michael Alexander moved, seconded Ann McColley to approve this MOU. Motion carried. Mr. James then asked that First State Bank of Newcastle be declared a depository of public funds. Tom Voss moved, seconded Ann McColley to declare First State Bank of Newcastle a depository of public funds. Motion carried. Mr. James noted the letters to the service providers have been sent.
City Engineer Mike Moore reported on progress with the landfill closure permit and the RT Communications pre-bid meeting, noting this will be the concluding year for their construction project. Mr. Moore brought up a couple of project proposals and a couple of complaints about vehicles in an alley. One project may be taken under advisement. The claim on the complaint was the items in the alley constituted a safety hazard. Mr. Moore and Chief Owens had investigated this and found this was not a true assertion. Chief Owens indicated the Police Dept. was not going to pursue the issue farther.
City Police Chief Jim Owens reported calls for service for February. Chief Owens noted a police vehicle had been damaged but was being taken care of by the other driver’s insurance. The new Chevrolet Tahoe is to be delivered tomorrow. Ginger Fields has taken over use of the cat impound facility on a 90 day trial basis. The City will maintain maintenance of the building.
City Attorney Jim Peck reported that Axe Court ownership is being looked into by a title company who is tracing the ownership. WYDOT is still looking into easements for the water tank. There is a voluntary annexation in the works. Mr. Peck is watching for potential legislation that may affect the City.
